Additional Terms for Business Accounts
These Business Terms apply to your use of a Business Account and the Business Portal (together, the "Business Site") and are in addition to the Terms of Service. If there is a conflict, these Business Terms control for Business Accounts.
A) Requirements, Representations, Warranties
By creating or using a Business Account, you represent and warrant that:
- You are an authorized representative of the business claimed/managed through your account (“Business”) and can bind the Business to these Terms
- Your Business complies with applicable laws and does not offer or advertise illegal products or services.
- Information you provide (e.g., halal claims, certifications, menus, photos, hours, locations) is accurate and kept up to date.
- Halal claims. You are solely responsible for any halal claims, representations, or certifications you publish. If you state or imply certification, you must accurately identify the certifying body and maintain valid certification. You agree not to misrepresent halal status, ingredients, or preparation.
- No review manipulation. You will not solicit, incentivize, pay for, suppress, or modify reviews; post reviews for your own Business or competitors; or otherwise attempt to manipulate ratings, search, recommendation, or moderation systems.
- Data access. You grant us a non-exclusive, royalty-free license to display your publicly available website/content (including via iframes or similar) and to access, cache, index, and reproduce such materials to provide the Service.
- Laws on consumer reviews. You will not include or enforce “gag” or non-disparagement clauses against consumers. You acknowledge such clauses are prohibited under applicable U.S. law and that we may place consumer alerts about attempts to restrict reviews
B) Health, Safety, and Regulatory Notices
We may display public health scores or regulatory information and, in our discretion, add consumer alerts related to health, licensing, or misleading claims (including halal misrepresentation).
C) Payments; Ads; Deals (If Applicable)
If you purchase advertising, premium profiles, bookings, or other paid services, those purchases are governed by the specific order terms and payment terms presented at checkout. Fees are non-refundable unless expressly stated.
D) Disclaimers; Limitation of Liability (Business)
In addition to the general disclaimers and limitations above, you acknowledge that laws such as 47 U.S.C. § 230 (CDA) and applicable anti-SLAPP statutes may bar claims attempting to hold us liable for user reviews or other third-party content. To the maximum extent permitted by law, our aggregate liability to your Business for all Business-related claims will not exceed the amounts paid by your Business to us in the 12 months preceding the claim or $1,000, whichever is greater.
E) Dispute Resolution (Business)
Except for claims that may be brought in small claims court or to protect IP rights, any dispute arising from or relating to these Business Terms or the Business Site will be resolved by binding individual arbitration administered by NAM under its commercial rules. Venue for in-person hearings is Orange County, California. Each party bears its own attorneys’ fees unless a statute provides otherwise. Class and representative proceedings are not permitted.
